Terms of Usage (이용약관)

Purpose & Scope of Service (목적 및 서비스 범위)

Welcome to KRiders ("Service", "we", "us", or "our"). These Terms of Usage ("Terms") constitute a legally binding agreement between you ("User", "Rider", or "you") and KRiders governing your access to and use of our mobile applications, websites, and associated services.

KRiders is designed to support domestic and international motorcycle travelers adventuring across the Republic of Korea by:

• Aggregating governmental open tourist spot information (including Korea Tourism Organization TourAPI data).
• Enabling community route recommendations, photos, comments, and travel logs.
• Facilitating social discovery among riders, group formation, and meetup event coordination.
• Providing real-time messaging channels between verified riders.

By creating an account, generating a cryptographic rider identity, or accessing any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms.

Eligibility & Rider Licensing (이용 자격 및 면허 요건)

To register an account and utilize KRiders, you must satisfy the following criteria:

• Legal Age: You must be at least 18 years of age (or the legal age of majority in your jurisdiction).
• Driver's License for Motorcycling: If you operate a motorcycle, scooter, or motorized two-wheeled vehicle in connection with routes or events discovered through KRiders, you must hold a valid, unexpired motorcycle driver's license authorized under the laws of the Republic of Korea.
• Foreign & Tourist Riders: International travelers operating a motorcycle in Korea must possess:
  1. A valid driver's license from their home country; and
  2. A valid International Driving Permit (IDP) issued under the 1949 Geneva Convention on Road Traffic, with explicit endorsement for Category A (two-wheeled motorcycles); or a valid Korean driver's license.
• Compulsory Insurance: Any vehicle operated by you must be covered by compulsory third-party liability motor vehicle insurance (책임보험 / 대인·대물배상) as required by South Korean law.

South Korean Traffic Regulations & Road Restrictions (대한민국 도로교통법 준수 의무)

Foreign riders touring Korea must be particularly mindful that typical GPS navigation applications may occasionally route onto automobile-only bypasses or bridges unless set to two-wheeler / non-motorway modes.

• Helmet Mandate: In accordance with Article 50 of the Road Traffic Act, wearing an approved motorcycle safety helmet (안전모) is mandatory for both drivers and passengers at all times. Failure to wear an approved helmet is an administrative infraction.
• Zero Tolerance for DUI (음주운전): South Korea imposes strict penal sanctions for driving under the influence of alcohol or narcotics (Blood Alcohol Concentration limit: 0.03%).
• Independent Verification: KRiders tourist spots, shared routes, and event meetup coordinates do not warrant that all connecting paths are accessible to two-wheelers. You must obey physical road signs (such as the red circular "No Motorcycles" sign — 이륜자동차 통행금지) at all times.

Cryptographic Key Accounts & Security (암호화 계정 및 개인키 관리 책임)

KRiders utilizes a privacy-preserving, cryptographic public-key infrastructure (PKI) for authentication:

• Key Pair Generation: When you sign up, your client device generates an asymmetric cryptographic key pair (a public key and a private key).
• Email Verification: Your email address is collected strictly to deliver one-time verification codes and authenticate key actions.
• Sole Custody of Private Key: Crucial Your private key is stored exclusively on your device. KRiders servers NEVER receive, access, or store your private key.
• Irrevocable Loss Disclaimer: You are solely responsible for safeguarding, exporting, or backing up your private key (e.g. via QR code or text backup). If you lose your private key or replace your device without a backup, KRiders cannot restore your account or access.
• Digital Signatures: High-value operations, including login, event commitments, and account withdrawal, require digital cryptographic signatures created by your private key. You agree that any operation signed with your private key is presumed executed by you.

Road Safety Disclaimer & Assumption of Risk (안전 면책 및 위험 부담)

By using KRiders, you explicitly agree and covenant:

1. Informational Nature: All content, ride logs, tourist spots, group plans, route recommendations, and navigational markers shared on KRiders are for general informational, educational, and recreational reference only. They do not constitute certified routing or engineering advice.
2. No Guarantee of Safety or Conditions: KRiders does not inspect, warrant, maintain, or verify the safety, passability, legal status, or surface conditions of any road, mountain pass, or trail referenced on the Service.
3. Rider Discretion & Prudence: You exercise sole, independent discretion regarding whether to ride, what speed to travel, what protective gear to equip, and which routes to follow based on your personal riding skills, motorcycle condition, and prevailing weather.
4. Release of Claims: To the fullest extent permitted by applicable law, you knowingly and voluntarily release, waive, and discharge KRiders, its developers, operators, contributors, and affiliates from any and all liability, claims, or demands arising out of any motorcycle accident, traffic violation, property damage, bodily injury, or wrongful death sustained while using the Service.

Acceptable Use & Community Code of Conduct (이용자 준수 사항 및 금지 행위)

KRiders is dedicated to fostering a welcoming, respectful, and safe community for riders worldwide. You agree not to engage in any of the following prohibited behaviors:

User-Generated Content & Intellectual Property (게시물 및 지식재산권 라이선스)

Ownership: You retain complete ownership, copyright, and intellectual property rights in all text, photographs, route reviews, comments, and media you publish on KRiders ("User Content").

License Grant to KRiders: In order to operate the Service, when you submit User Content to public sections of the app (such as community posts or public event galleries), you grant KRiders a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to:

• Host, cache, store, and process your content (including generating optimized thumbnail variants across resolutions for mobile display).
• Display, reproduce, format, and distribute your content across KRiders applications and community feeds.

This license exists solely for the purpose of operating, improving, displaying, and promoting the KRiders platform and terminates when you delete your content or withdraw your account, subject to temporary technical backups.

Content Moderation: KRiders reserves the right (but assumes no obligation) to pre-screen, review, flag, filter, modify, or permanently delete any User Content that violates these Terms, infringes legal regulations, or compromises community safety.

Rider Meetups, Groups & Events (라이딩 그룹 및 이벤트 참가 수칙)

KRiders allows riders to create and participate in riding groups, chat channels, and meetup events ("Events"):

• Independent User Organization: Events and group rides organized via KRiders are created independently by individual users. KRiders is not an event organizer, tour guide, transportation coordinator, or commercial sponsor.
• Voluntary Participation: Joining any ride, group, or in-person meetup is done strictly at your own voluntary election and peril.
• Inter-User Conduct: KRiders exercises no control over, and assumes no responsibility for, the conduct, driving manner, honesty, or mechanical roadworthiness of other riders participating in an Event.
• Disputes: Any disputes, collisions, financial transactions, or disagreements arising between riders during in-person rides must be resolved directly between the affected parties.

Account Withdrawal & Service Termination (회원 탈퇴 및 이용 제한)

Voluntary Withdrawal: You have the absolute right to terminate your account and withdraw from KRiders at any time.

• In the app settings, navigate to Quit KRiders.
• To prevent fraudulent deletion, you must type the confirmation phrase: "I agree to delete all information created by myself and withdraw from KRiders service." and compute a digital signature using your private key.
• Upon verification, your email address, cryptographic public key, push notification tokens, and profile identifiers are permanently erased from the database, and associated media files are queued for permanent deletion.

Termination by KRiders: We reserve the right to suspend or permanently revoke access to the Service at our sole discretion, without liability, if you breach any material provision of these Terms, engage in fraudulent or hazardous activity, or if required by court order or governmental mandate.

Disclaimers & Limitation of Liability (책임의 제한 및 보증의 부인)

"AS IS" and "AS AVAILABLE": The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular riding purpose, non-infringement, or uninterrupted availability.

Limitation of Damages: To the maximum extent permitted by applicable law in the Republic of Korea:

• In no event shall KRiders, its operators, employees, or infrastructure providers be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages whatsoever (including, without limitation, damages for loss of profits, loss of motorcycle use, vehicular damage, medical expenses, physical injury, or wrongful death).
• Our total aggregate liability for all claims arising out of or related to the Service or these Terms shall not exceed the amount actually paid by you to KRiders (if any) during the twelve (12) months preceding the event giving rise to liability.

Governing Law & Dispute Resolution (준거법 및 재판관할)

These Terms, their interpretation, and any disputes arising out of or related to your use of the Service shall be governed by and construed in accordance with the substantive laws of the Republic of Korea, without regard to conflict of laws principles.

Any legal lawsuit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the competent court having jurisdiction over the location of the KRiders service operator (such as the Seoul Central District Court), and both parties hereby consent to the personal jurisdiction and venue of such courts.

Inquiries & Amendments to Terms (약관의 개정 및 문의)

We may modify or update these Terms periodically to reflect evolving features, operational adjustments, or changes in applicable traffic or privacy regulations.

When modifications occur, we will update the "Effective Date" at the top of this document. Material changes will be communicated in advance through in-app notifications or to your registered email address. Continued use of KRiders after the effective date constitutes acceptance of the amended Terms.
